END USER LICENSE AGREEMENT (EULA)

Definitions

In this EULA, the following definitions, when capitalized, shall have the following meanings:

App/Game – refers to our game available on the Steam platform, including any downloadable software, game files, patches, updates, expansions, downloadable content (DLC), and any related services.
Company (or “Sirius Gaming”, “We”, “Us”, “Our”) – means Sirius Gaming SRL, a company registered in Romania, registration number 37569421, with its registered office at Saturn 36, Brașov, Romania.
Content – means all elements of the App/Game, including but not limited to, the design, mechanics, characters, levels, environments, sound, music, graphics, videos, text, and software.
Device – means a personal computer (PC) or other hardware capable of running the App/Game, which You own or otherwise legally control for personal, non-commercial use.
EEA – means the European Economic Area.
EULA – means this End User License Agreement, which is the legal agreement between You and Us, governing the use of the App/Game.
Intellectual Property Rights – means any rights under patent, trademark, copyright, trade dress, and trade secret laws, or any other proprietary rights worldwide.
Open Source Software – means any portion of the App/Game that is governed by a separate open-source license.
Policy – refers to our Privacy Policy, which describes how We collect, use, process, store, and share Your data.
Services – refers to the App/Game and any related services We provide through it, including any online features, multiplayer components, or downloadable content.
Steam – refers to Valve Corporation’s platform where the App/Game is published, distributed, and played.
Third-Party Suppliers – means third-party companies that provide software, tools, services, or integrations in connection with the App/Game (e.g., Unity, Sentry, Steamworks).
You (or “Your” or “User”) – means the person using the App/Game under this EULA.

About this EULA and Sirius Gaming

This EULA constitutes a legal agreement between You and Sirius Gaming regarding the use of the App/Game.

By installing, accessing, or using the App/Game, You agree to be bound by the terms and conditions of this EULA, as well as our Privacy Policy. If You do not agree, You must not install, access, or use the App/Game.

By using the App/Game, You confirm that:

You are at least 13 years old (or the required age in Your country to play games of this type).
If You are between 13 and 18 years old, Your parent or guardian has reviewed and agrees to these terms.
You own or have legal permission to use the Device on which You install and play the App/Game.

License to Use the App/Game and Limitations

License Grant

We grant You a limited, non-exclusive, personal, revocable, non-transferable license to install and use the App/Game for personal entertainment purposes only. This license does not grant You ownership of the App/Game.

License Restrictions

You may not:

Sell, distribute, sublicense, or transfer the App/Game to anyone else.
Modify, reverse-engineer, decompile, or create derivative works based on the App/Game.
Use cheats, bots, automation software, or hacks that modify the App/Game’s functionality.
Circumvent any security measures, Digital Rights Management (DRM), or licensing controls.
Use the App/Game for commercial purposes without Our written consent.

Any breach of these restrictions may result in immediate termination of this EULA and Your access to the App/Game.

Installation, Access, and Usage

You are responsible for selecting and maintaining the required hardware and internet connection for playing the App/Game.
The App/Game’s performance may vary based on Your system specifications and internet connection.
We do not guarantee that all features of the App/Game will be available in all regions or languages.

Privacy

Your use of the App/Game is subject to Our Privacy Policy, which details how We handle personal data. The App/Game may collect certain data for analytics, crash reporting, and gameplay improvement through third-party services such as:

Unity Analytics (game performance tracking)
Sentry (crash reporting)
Steam (account integration, achievements, cloud saves)

Content and User Conduct

When using the App/Game (especially in multiplayer or online features), You agree to:

Not engage in harassment, hate speech, cheating, or exploiting bugs.
Not share offensive, illegal, or harmful content.
Follow all applicable laws and Steam’s Code of Conduct.

We reserve the right to restrict or terminate access to online services if You violate these rules.

Intellectual Property

The App/Game, including all Content, trademarks, and Intellectual Property Rights, belongs to Sirius Gaming or its licensors. You are granted a license to use the App/Game, but You do not own any part of it.

You may not:

Copy or distribute game assets.
Use the App/Game’s Content in any external projects without permission.
Claim ownership of the App/Game or its Content.

Updates and Changes

We may release updates, patches, or new versions of the App/Game at Our discretion. Some updates may be required to continue playing. We are not obligated to maintain or support older versions.

If significant changes to this EULA occur, We will notify You through Steam or in-game notifications.

Disclaimer of Warranties

THE APP/GAME IS PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES REGARDING PERFORMANCE, SECURITY, OR FITNESS FOR A PARTICULAR PURPOSE.

WE DO NOT GUARANTEE THAT:

THE APP/GAME WILL RUN UNINTERRUPTED OR ERROR-FREE.
THE APP/GAME WILL BE COMPATIBLE WITH ALL SYSTEMS.
BUGS WILL BE FIXED IMMEDIATELY OR AT ALL.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

SIRIUS GAMING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP/GAME.
OUR TOTAL LIABILITY, UNDER ANY CIRCUMSTANCES, SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP/GAME IN THE LAST 12 MONTHS.

Termination

We reserve the right to suspend or terminate Your access to the App/Game if You violate this EULA. Upon termination, You must uninstall the App/Game.

Dispute Resolution and Governing Law

This EULA is governed by the laws of Romania. Any disputes shall be settled in the courts of Romania, unless You reside in the United States, in which case the Dispute Resolution for U.S. Users section applies.

Dispute Resolution for U.S. Users

Disputes shall be resolved by binding individual arbitration in accordance with the American Arbitration Association (AAA) rules.
You waive any right to a class action lawsuit.
If You wish to opt out of arbitration, You must notify Us within 30 days of agreeing to this EULA.

Changes to This Agreement

We reserve the right to modify this EULA at any time. Continued use of the App/Game after changes constitutes acceptance of the revised terms.
